DATENSCHUTZERKLÄRUNGPrivacy policy
This notice explains how we handle personal data. Section 3 covers data that reaches us because you visit this site or contact us. Section 4 covers business contact data that we obtained from sources other than you — read that section if we approached you and you never gave us your details.
1. Controller
Noah Pieper, acting on behalf of Atagno Software Solutions GmbH (in formation), Neulücken 19, 6430 Schwyz, Switzerland. Contact for all data protection matters: noah.pieper@atagno.com.
2. Applicable data protection law
We are based in Switzerland, so the Swiss Federal Act on Data Protection (FADP) is the primary law governing our processing of personal data.
Where our processing activities fall within the territorial scope of Article 3 GDPR — in particular where we specifically offer goods or services to individuals in the EU or EEA, or monitor their behaviour within the EU or EEA — the GDPR applies in addition to Swiss data protection law. References to GDPR provisions in this notice apply to the extent the GDPR is applicable to the processing in question.
3. Processing in connection with this website
3.1 Server log data
This site sets no cookies, runs no analytics and loads no third-party resources — fonts are served from our own domain. Our hosting provider, Cloudflare, processes technical data that your browser transmits when it requests a page, such as IP address, time of the request, the requested address, referrer and browser identification.
- Purposes: delivering the website, ensuring its security and stability, and troubleshooting
- Basis: our interest in operating a functioning and secure website; where the GDPR applies, Art. 6(1)(f) GDPR
- Profiling: we do not build visitor profiles and we do not track visitors across sites
3.2 Contacting us by email
If you write to an address published on this site, we process your email address, your name and the content of your message in order to respond. Our mail is operated on Microsoft services. Where the GDPR applies, the basis is Art. 6(1)(b) GDPR for steps taken at your request prior to a contract, and otherwise Art. 6(1)(f) GDPR.
3.3 The survey
The survey linked from the home page is hosted on Microsoft Forms and opens on Microsoft's own infrastructure. Anything you enter there is submitted to Microsoft and made available to us, and Microsoft's own privacy terms govern that step. Participation is voluntary. Where the GDPR applies, we rely on your consent under Art. 6(1)(a) GDPR, which you may withdraw at any time with effect for the future.
3.4 External links
This site links to external services, including the survey and our social media profile. Following such a link takes you to a third-party website whose operator is responsible for its own data processing. We have no control over that processing.
4. Business contact data from public and other sources
For business development we process professional contact data that we did not receive from the person concerned. Where the GDPR applies, Article 14 GDPR requires us to provide the following information, and to do so at the latest within one month of obtaining the data, or at the first communication with the person if that occurs earlier.
- Categories of data
- Name; company; function or position; business email address; business telephone number where publicly available; and publicly available business information about the company and the professional role. We do not seek out or process sensitive personal data in this context.
- Sources
- Company websites; publicly visible professional profiles such as LinkedIn; commercial registers; industry directories; trade fair and exhibitor directories; and other publicly accessible business sources.
- Purposes
- Business development, market research, business-to-business communication, and getting in touch in connection with treede.
- Basis for the processing
- Where applicable, the processing of publicly available professional contact data may be based on our legitimate interest under Art. 6(1)(f) GDPR, and on the corresponding grounds under Swiss data protection law. Whether processing this data is permitted and whether a given marketing message may be sent are two separate questions — see the note below.
- Recipients
- Providers that operate our email and business systems and host our website, acting on our behalf. See section 5.
- Automated decision-making
- We do not make decisions about individuals by automated means and we do not carry out profiling in this context.
5. Service providers and international transfers
We use external service providers who may process personal data on our behalf. As things stand, these are Cloudflare for hosting and delivery of this website, and Microsoft for email and for the survey.
Personal data may be processed in Switzerland, the European Economic Area and the United States. Where personal data is transferred to countries without an adequate level of data protection, we use appropriate safeguards where required, such as recognised contractual safeguards. For transfers to certified organisations in the United States, applicable adequacy frameworks such as the Swiss–U.S. Data Privacy Framework may also be relied upon. Whether a specific provider is certified under such a framework depends on that provider's own current certification status.
6. Retention
Technical data is retained only for as long as necessary for the operation, security and troubleshooting of the website, or according to the configured retention periods of the respective service provider.
Correspondence is retained for as long as the matter requires and is deleted afterwards, unless a longer retention period is required by law. Business contact data is retained for as long as it is relevant for the stated business purposes, unless the data subject objects, requests deletion where applicable, or a longer retention period is required by law.
7. Your rights
Depending on the applicable law, you may have rights including access, correction, deletion, data portability and objection. Under the Swiss Federal Act on Data Protection, the applicable rights arise under Swiss law. Where the GDPR applies, the rights under Articles 15–21 GDPR apply additionally, and where processing is based on consent you may withdraw that consent at any time with effect for the future.
To exercise any of these rights, write to noah.pieper@atagno.com. We respond within the time limits provided by the applicable law. We may need to ask you for information to confirm your identity before we act on a request.
8. Data protection adviser and data protection officer
We have not appointed a data protection adviser under Article 10 Swiss FADP. For private controllers in Switzerland, the appointment of such an adviser is generally voluntary.
Where the GDPR applies, we currently do not consider the requirements for mandatory appointment of a data protection officer under Article 37 GDPR to be met. We keep this under review as our activities develop.
9. Representative in the EU
If our activities in the EU or EEA expand and the requirements of Article 27 GDPR become applicable, we will appoint an EU representative where legally required and update this privacy notice accordingly.
10. Complaints
In Switzerland, you may contact the Federal Data Protection and Information Commissioner (FDPIC), Feldeggweg 1, 3003 Bern. Where the GDPR applies, you may lodge a complaint with a supervisory authority in the EU or EEA, in particular in the member state of your habitual residence, your place of work, or the place of the alleged infringement (Art. 77 GDPR).
11. Changes to this notice
We update this notice when our processing activities or the legal framework change. It will in any case be updated once Atagno Software Solutions GmbH is entered in the commercial register.
